Building, Engineering & Construction

The Building, Engineering and Construction Division deals with all contractual, commercial and dispute resolution matters relating to building, engineering and construction projects and industries including:

  • Drafting, negotiating, settling, reviewing and compiling of construction and engineering contracts
  • Selection of professional construction teams, including agreements for the appointment of engineers, architects, quantity surveyors, project managers and other building professionals
  • Dealing with, compiling, amending and advising on standard form contracts such as FIDIC, JBCC, GCC and NEC
  • Drafting, compiling, dealing with and advising on public and private procurement processes and documentation, including all bid invitation and submission documents, bid evaluation and scoring, and contract awards
  • Preparation of documentation and submission for expressions of interest, requests for qualifications, requests for bids, tender invitations and requests for quotations
  • Drafting and advising on ancillary documentation including payment and performance guarantees, securities, payment certificates and milestone certificates
  • Advising on all aspects of national and international projects including tax, incentives, financing, import, export, exchange control, insurance, EIAs, permit approvals and licensing
  • Dealing with, managing and advising on claims, including drafting of notices and responses, as well as communications from principal agents and engineers, including instructions, rulings and awards
  • Advising on and handling informal dispute resolution processes, expert determinations, adjudication, mediation, arbitration and court litigation
